Terms of Use for the "ACCESSIBILITÉ, JOUEZ LA BONNE CARTE" Game

Introduction

These Terms of Use govern access to and use of the "ACCESSIBILITÉ, JOUEZ LA BONNE CARTE" game (the "Game"), made available for download by THE NAME IS TAMARA, a single-member limited liability company registered with the Paris Trade and Companies Register under number 999267842 (the "Publisher"), and created by Ms Tamara SREDOJEVIC (the "Author"), through the website https://www.tamarasredojevic.com/ (the "Website").

Access to, consultation of and use of the Game, whether in its free or paid version, is subject to the User's prior, unconditional acceptance of these Terms of Use and of the Privacy Policy, which forms an integral part thereof.

Any use of the Game requires prior review and acceptance of these Terms of Use. Users acknowledge that use of the Game is subject to compliance with all provisions set out herein.

The purpose of these Terms of Use is to define the conditions governing the User's access to and use of the Game.

Acceptance and Enforceability of the Terms of Use

Acceptance

The User may access, consult and use the Game, whether in its free or paid version, subject to the prior, express and unconditional acceptance of these Terms of Use.

Acceptance is formalised by ticking a checkbox displayed during the download or purchase process, the wording of which varies depending on the version of the Game.

Free version

I accept the Terms of Use and the Privacy Policy.

Paid version

I accept the Terms of Use and the Terms and Conditions of Sale and expressly waive my right to cancel for digital products.

By ticking the relevant checkbox, the User acknowledges having read and understood the applicable terms and agrees to be bound by them.

Amendments

The Publisher reserves the right to amend these Terms of Use at any time as it deems necessary.

The version of the Terms of Use available on the Website at https://www.tamarasredojevic.com/ shall prevail over any previous printed or electronic version.

Any continued use of the Game following an amendment to these Terms of Use shall constitute acceptance of the amended Terms of Use by the User.

Enforceability

These Terms of Use shall be enforceable against the User from the date of the User's first download of the Game and throughout the entire period during which the User accesses, consults and/or uses the Game, until such time as they are replaced by a new version of the Terms of Use.

Duration

These Terms of Use shall remain applicable for the entire duration of the User's access to, consultation of and/or use of the Game, until such access, consultation and/or use ceases.

Description of the Game and Available Versions

The game "ACCESSIBILITÉ, JOUEZ LA BONNE CARTE" is an educational tool designed to promote accessibility and challenge common misconceptions.

The Game is made available to the User in the form of a downloadable digital file accessible online, as well as in printed format.

Depending on the version selected, the use of certain tools such as Google or Figma accounts may be required.

The Game is offered in a free version and a paid version.

Free version

The free version of the Game is made available free of charge and does not include access to any paid workshop services.

This version includes 30 cards accompanied by guidance notes to facilitate workshop delivery.

It is available immediately upon download of the file.

The cards are provided in .pdf, .gdoc and Word formats to ensure compatibility with assistive technologies and enable conversion into Braille.

Paid version

Two versions are available:

Access to the Game

The Game is accessible via the "Accessibility, Play Your Cards Right" page, available from the "Resources" section of the Website.

From this page, the User may choose between the free version and the paid version of the Game.

To access the free version of the Game, the User must complete a Google Form, which requires the use of a Google account. The User is required to provide the following information: email address; professional occupation.

The User must also accept the Terms of Use and Privacy Policy before submitting the form.

Once the form has been submitted, the User is granted access to the Game via a downloadable link.

The "Prepare your workshop" folder includes the Game documentation in PDF and Word formats.

The "Printable cards" folder includes the Game cards in PDF format and a Word version enabling conversion into Braille.

To access the paid version of the Game, the User must complete the purchase process via Stripe.

Upon successful payment, the User is automatically redirected to a dedicated page on the Website containing a link to a FigJam file.

This link allows the User to duplicate and use the digital version of the Game in accordance with these Terms of Use.

Access to the Game is strictly conditional upon completion of the relevant process described above for either the free or paid version.

Use of the game

The User's access to and use of the Game is subject to compliance with the provisions below, which the User undertakes to respect.

In the event of breach of any of these provisions, the Publisher may immediately and automatically terminate the User's access to and use of the Game without prior notice.

Authorised Use of the Game

The User is authorised to use the cards free of charge in a non-commercial and non-professional context, in the following cases:

The User is also authorised to use the cards internally for professional purposes on a non-paid basis, including within organisations (companies, associations, public bodies, NGOs, etc.) for internal staff use.

Such internal professional use is subject to the following conditions:

In all cases, the User undertakes to clearly acknowledge the Author (Ms Tamara SREDOJEVIC) and the Publisher (THE NAME IS TAMARA) and to include a link to the Website (https://www.tamarasredojevic.com/ or any replacement website), in any materials produced by the User in relation to the Game. Such acknowledgement must be clearly visible and legible.

The following wording may be used as an example:
"The game ‘ACCESSIBILITÉ, JOUEZ LA BONNE CARTE’ is an original creation by Tamara SREDOJEVIC and her company THE NAME IS TAMARA. Full information about the Game is available at https://www.tamarasredojevic.com/."

Unauthorised Use of the Game

Commercial or promotional use

Any use of the Game giving rise to financial consideration (for example, corporate training services) is prohibited without the prior written authorisation of the Author.

The cards and their content may not be modified without the express authorisation of the Author, including but not limited to:

Reproduction

Any reproduction of the Game, whether digital or physical, without the prior written authorisation of the Author and the Publisher is strictly prohibited and may give rise to legal proceedings.

Any resale or distribution (whether free or paid) of the Game without prior written authorisation of the Author and the Publisher is prohibited.

Any breach of the above restrictions may result in the User's liability and expose them to legal action.

Intellectual Property

Ms Tamara SREDOJEVIC is the author of the Game. In accordance with the Introduction and following the French Intellectual Property Code where applicable, the Game is protected by copyright.

All trademarks, logos and other distinctive signs, visuals, photographs, texts, comments, illustrations, drawings and images reproduced in the Game and on the Website are protected under intellectual property laws. Any reproduction, in whole or in part, of these elements is strictly prohibited without the prior written consent of the Author.

The Website illustrations are sourced from Flaticon (https://www.flaticon.com/) and are used in accordance with the licences granted to the Publisher. These elements remain the property of Flaticon and any reproduction is subject to their authorisation.

Any reproduction, representation, adaptation, translation, modification, extraction, distribution, commercialisation or exploitation of all or part of the Game, in any form or by any means (digital, print, photocopy, online sharing), is prohibited without the prior written authorisation of the Author.

The User undertakes not to use the content of the Game or Website in any manner that may infringe the rights of the Author, or constitute infringement, unfair competition or parasitic behaviour.

Any non-compliant use may result in termination of access to the Game.

Acceptance of these Terms of Use and download of the Game do not imply any transfer of intellectual property rights or any authorisation other than those expressly set out herein or in the Terms and Conditions of Sale.

Personal data

The Publisher processes the User's personal data in accordance with the General Data Protection Regulation (GDPR).

The data collected (email address, professional occupation, payment information, etc.) is used for the purposes of contact, order management, communication and compliance with legal obligations.

Disclaimer of Warranty

The compliance of these Terms of Use is assessed as of their effective date.

The Publisher does not guarantee their ongoing suitability in the event of future legislative, regulatory or case-law developments.

Governing Law and Jurisdiction

These Terms of Use are governed by French law, both as to substance and form.

In the event of any dispute relating to these Terms of Use, exclusive jurisdiction shall be vested in the courts of Paris, notwithstanding multiple defendants or third-party proceedings.
